California Insurance Customer Rights

Know your rights when repairing your vehicle after an accident

 

Insurers may NOT misrepresent coverage, delay payment without justification, fail to investigate properly, or refuse a fair settlement when liability is reasonably clear.

You have the legal right to choose your repair facility. Insurers may not pressure, intimidate, mislead, or steer you to a specific shop.

TIMELY COMMUNICATION — 10 CCR §§ 2695.5 & 2695.7

Insurers must respond promptly, conduct a fair investigation, and keep you informed before denying, delaying, or limiting any part of your claim.

Any denial, delay, or limitation must be in writing and clearly explain the policy language and facts relied upon.

Your vehicle must be restored to its pre-loss safety, function, fit, finish, and appearance. Cost-driven repairs are not allowed.

Exterior lighting components (headlights, tail lamps, DRLs, reflectors) are federally regulated safety devices. Insurers may

NOT require non-compliant aftermarket or remanufactured lighting.

Insurance companies CANNOT require out-of-pocket payment for covered repairs needed to restore your vehicle.
